Further information

Help for widows & widowers

There are a number of benefits you may be entitled to after the death of a husband or wife. These are dependant on age, National Insurance (NI) contributions paid & the number of children living with you.

You will not be able to receive these benefits if you are divorced from your husband or wife, you remarry, you are living with somebody else as husband or wife without being legally married or you are in prison & being held in legal custody.

Bereavement Payment

This is a tax free lump sum that is paid as soon as you are widowed. You will be entitled to this payment if:

Your late husband/wife met the necessary NI contribution conditions
or his or her death was caused by their job
& your husband or wife were not entitled to Retirement pension when he or she died
or you were under the age of state pension when your husband or wife died.

There are also other benefit payments you may be entitled to & your local benefits office will be able to advise you further.

Solicitors

It may be advisable to contact a solicitor to complete the deceased’s estate, this need not involve a large expense & most solicitors will give a written estimate of costs prior to starting any work for you.

Probate & letters of administration

If the deceased has not left a will then you may need to apply to the local probate court for letters of administration, this can be done without the aid of a solicitor. You can obtain help & advice by calling the probate court.

Insurance policies

Insurance companies should be notified as soon as possible of the death of an insured person. Relatives or executors should confirm that insurance is in force. Insurance companies will require the following:

The policy itself

A copy of the death certificate

Proof of identity

Premium receipt book if applicable

Motor insurance

Insurance cover on a vehicle owned & insured solely by the deceased ceases immediately at the time of death. The nearest relative or executor should inform the insurance company who can operate immediate transfer of cover. The car registration book should be returned to the licensing authority for transfer of ownership. The driving license should also be returned to the issuing authority.
